NOTICE OF HEARING BY THE HEARINGS TRIBUNAL OF THE ALBERTA COLLEGE OF SOCIAL WORKERS PURSUANT TO S. 77(a) OF THE HEALTH PROFESSIONS ACT, R.S.A. 2000, c. H-7

 

CONSENT ORDER

 

AGREED STATEMENT OF FACTS

 

 

At all material times K was a Registered Social Worker with the Alberta College of Social Workers (“ACSW”).

 

Notices were provided on numerous occasions between 2000 and 2006 advising of K’s obligation to provide his continuing competency portfolio.

 

Notwithstanding the requests from ACSW, K failed to provide information to satisfy the continuing competency requirements pursuant to the Health Professions Act, supra.

 

As a result of the aforementioned, K’s permit to practice was suspended on November 15, 2006.

 

K continued to practice social work after his permit to practice was suspended.

 

K ultimately provided the appropriate portfolio to the ACSW in April of 2007.

 

ACKNOWLEDGEMENT OF RESPONSIBILITY

 

It is acknowledged by K and the Alberta College of Social Workers that his conduct as described in the Agreed Statement of Facts constitutes unprofessional conduct.

 

AGREED FINDINGS

 

 

That on or about November 15, 2006, your permit to practice social work was suspended by the Alberta College of Social Workers.  On February 17, 2007 upon being contacted by the Investigator as a potential client, you agreed to make an appointment to meet with her for the purpose of practising social work. Further you have admitted that you continued to practice social work while your permit to practice was suspended. 

Such conduct contravenes s.40(a), 41, and 44(e) of the Standards of Practice and s.2.2, 2,3, 4, 9.2, and 9.4 of the Code of Ethics and consequently such conduct constitutes unprofessional conduct.

 

NO RIGHT TO APPEAL

 

The ACSW and K agree that there shall be no appeal from this Order notwithstanding s. 87 of the Health Professions Act, R.S.A. 2000, c H-7.

 

JOINT SUBMISSION AS TO SANCTIONS

 

The ACSW and K jointly submit that the appropriate sanctions in the circumstances are as follows:

 

 

K will pay costs of $8,000.00.

 

K shall meet with the Continuing Competency Committee (in person).

 

K shall be subject to supervision for a period of one year, the costs of which will be borne by K.  The supervisor shall be agreed upon by K and the ACSW.
